Conclusions

Since October 2023, the systematic torture of Palestinians has become an integral part of Israel's colonial-colonialist genocide, serving as a tool of violence. annihilator a direct attack against Palestinians as a people. During detention, Palestinian prisoners have been subjected to exceptionally brutal physical and psychological abuse, on a scale and with an intensity unprecedented in the history of Palestine/Israel. Brutal beatings, sexual violence, rape, lethal mistreatment, starvation, and the systematic deprivation of the most basic human necessities have inflicted deep and lasting scars on the bodies and minds of tens of thousands of Palestinians and their loved ones. These practices demonstrate that the Israeli detention system has devolved into a regime of systematic and widespread humiliation, coercion, and terror, aimed at stripping Palestinians not only of their freedom, but also of their dignity, identity, and even their most basic sense of humanity. Far from being isolated excesses, such behaviours have been institutionalised within detention facilities, politically supported by the Israeli authorities, and publicly justified, or even celebrated, by certain segments of society.

In addition to detention, Palestinians are subjected to conditions that, cumulatively, they inflict severe collective physical and psychological suffering: mass killings, mass displacement, mass destruction of homes and infrastructure, mass starvation, mass deprivation, including essential medical care, and constant exposure to violence and humiliation with no possibility of redress. In this torturous environment, the intentional destruction of conditions necessary for life renders daily existence an ordeal of exhaustion, trauma, and precariousness.

Targeting the entire population, throughout the occupied territory, through a series of behaviours, genocide has become the ultimate form of torture: continuous, generational and collective. Recommendations

Recalling her previous 58 recommendations, the Special Rapporteur further recommends that:

Israel should:

Member States should:

To respect the obligation not to participate in or be complicit in Israeli crimes, and instead to prevent and address serious violations of international law, particularly those provided for by the United Nations Charter and the Genocide Convention, and to ensure that acts of genocide, torture, and ill-treatment are investigated and prosecuted.

Strengthen mechanisms and resources for the collection of evidence for criminal proceedings, clarify the fate and whereabouts of all disappeared Palestinians and ensure that Israel provides adequate compensation to Palestinian victims. Activate universal jurisdiction mechanisms to prosecute individuals and legal entities suspected of involvement in grave violations and other international crimes, including genocide and torture.

Psychosocial support programmes for survivors, particularly former detainees and survivors of torture and sexual violence, should be internationally funded, for example through the allocation of the UN Voluntary Fund for Victims of Torture to Palestinian NGOs, and should facilitate the transfer of survivors to third states.

To the Office of the Prosecutor of the International Criminal Court:

Investigate and prosecute acts of genocide, torture, and ill-treatment and, in this context, immediately request arrest warrants for Israeli officials, particularly Ben-Gvir, Katz and Smotrich, suspected of having perpetrated and/or ordered the heinous crimes described in this report, as well as for the Chief of Staff of the Israeli army and senior IPS officials responsible for detention centres.
