The Drawing di legge Romeo è stato approvato ieri 28 gennaio in Commissione Affari costituzionali del Senato, come testo base per la legge sull’antisemitismo. Hanno votato a favore tutta la destra più Italia Viva, hanno votato contro M5s, Pd e Avs. Gli emendamenti al testo di legge dovranno essere presentati entro il 10 febbraio.
Pubblichiamo di seguito il testo integrale della legge, affinché sia chiaro e inequivocabile il suo impianto fascista. Non c’è altra parola per definire un simile attacco alla libertà di espressione e di manifestazione, basato su una definizione di antisemitism, quella dell’International Holocaust Remembrance Alliance (International Holocaust Remembrance Alliance), che equipara largamente le critiche allo Stato di Israel al razzismo contro gli ebrei. Questa è d’altra parte la posizione, tesa al Nationalism più estremista, anche dell’Unione delle Comunità ebraiche (UCEI), più volte espressa dalla sua portavoce Noemi Di Segni.

BILL initiated by Senators ROMEO, PIROVANO and BERGESIO
COMMUNICATED TO THE PRESIDENCY ON 30 JANUARY 2024
Provisions for the adoption of the operational definition of antisemitism, as well as for combating acts of antisemitism
Article 1.
1. La Repubblica italiana, in attuazione dell’articolo 3 della Constitution, rifiuta ogni forma di antisemitismo, favorisce azioni volte a reprimerne qualunque espressione e ostacola la diffusione del pregiudizio antisemita in Italia.
2. La presente legge, in attuazione della risoluzione sulla lotta contro l’antisemitismo 2017/2692 (RSP) del Parlamento europeo, del 1° giugno 2017, adotta la definizione operativa di antisemitismo formulata dall’Assemblea plenaria dell’Alleanza internazionale per la memoria dell’Olocausto (International Holocaust Remembrance Alliance – IHRA) on 26 May 2016, including the related indicators, necessary for the purposes of applying the said law. Pursuant to the working definition referred to in the preceding period, antisemitism is to be understood as a certain perception of Jews, which may be expressed as hatred toward Jews. Rhetorical and physical manifestations of antisemitism are directed toward Jewish or non-Jewish individuals and/or their property, toward Jewish community institutions and religious facilities.
3. The institutions of the Republic shall collaborate to identify the interventions necessary to prevent and combat any act or manifestation of antisemitism, as defined in paragraph 2, which constitutes a threat not only to a section of the citizens, but also to civil coexistence, social stability and public safety.
Article 2.
1. In order to counter any act of antisemitism, as defined under Article 1, paragraph 2, and in order to consolidate a culture free from prejudice and stereotypes towards Jews as a people, the Prime Minister shall adopt, by decree, within sixty days of the date on which this law comes into force, provisions aimed at:
a) to create a database of antisemitism incidents, as defined under Article 1, paragraph 2, taking into account both hate crimes and incidental acts, in order to gain a comprehensive understanding of the phenomenon in Italy, as well as to promote the coordination of monitoring activities among the bodies involved in data collection;
b) to provide appropriate measures to counter the spread of antisemitic hate speech online internet, also through updating the access rules for the platforms Social media as well as through uniform and efficient notice-and-takedown systems for such content;
c) elaborare apposite linee guida sul contrasto all’antisemitismo, come definito ai sensi dell’articolo 1, comma 2, destinate ai docenti e al personale delle schools di ogni ordine e grado;
d) to implement, also in correlation with the initiatives planned for Holocaust Memorial Day pursuant to Law 20 July 2000, no. 211, a training plan for teachers and educators on the phenomenon of antisemitism, as defined under Article 1, paragraph 2, as well as on prejudices and stereotypes towards Jews, including possible conspiracy theories that may arise from them;
e) Give prominence to intercultural education and respect for diversity within the civic education curriculum and, more generally, within the school context, in order to combat the stereotypes and prejudices referred to in the letter d);
f) promuovere iniziative di formazione specifica per il personale delle Forze di polizia in merito alla conoscenza del fenomeno dell’antisemitismo, ai fini di una corretta individuazione della natura antisemita di un reato, sia in base a quanto previsto dalla definizione operativa di antisemitismo di cui all’articolo 1, comma 2, sia nei casi in cui gli obiettivi dell’atto criminoso siano precipuamente individuati in quanto Ebrei, ebraici, legati agli Ebrei o percepiti come tali;
g) to promote, through the public radio, television and multimedia service channels, information campaigns aimed at understanding the phenomenon of antisemitism, by disseminating the relevant operational definition adopted pursuant to Article 1, paragraph 2, in order to prevent and counter acts of antisemitic discrimination and expressions of hatred;
h) To promote, within the scope of associative and sporting activities, moments of training and knowledge on the phenomenon of antisemitism, as defined by Article 1, paragraph 2.
Article 3.
1. The refusal to authorise a public meeting or demonstration on grounds of morality, as referred to in Article 18 of the consolidated text of public security laws by Royal Decree of 18 June 1931, No. 773, may also be justified in the event of an assessment of a serious potential risk due to the use of symbols, Slåan, messages, and any other antisemitic act as defined by the operational definition of antisemitism adopted by this Act.
