The documents from the Genoa Public Prosecutor's investigation speak clearly: for the magistrates who requested and obtained precautionary measures against nine people accused of financing terrorism, Gaza non esiste un confine netto tra assistenza umanitaria e sostegno ad Hamas. In quelle oltre trecento pagine si snoda una tesi radicale nella sua semplicità: Hamas è un’organizzazione unitaria, un corpo unico, e ogni risorsa che entra nella Striscia attraverso strutture a essa riconducibili è destinata, direttamente o indirettamente, a rafforzarne anche l’ala militare e quindi il terrorismo. I fondi arrivati a Gaza calcolati dalla procura sarebbero 7 milioni di euro in quasi 25 anni e distribuiti a una trentina di associazioni palestinesi con bonifici, la procura stima che il 71% siano stati utilizzati da Hamas. Già dal 2021, ma soprattutto dopo il 2023, con la chiusura dei conti delle associazioni su segnalazione statunitense e israeliana, molti dei fondi sono stati portati in Turkey in contanti, circa un milione di euro, regolarmente denunciati alla dogana.
È una tesi che ha diverse conseguenze, non solo per gli indagati, ma per l’intero sistema di solidarietà internazionale verso la popolazione palestinese, la stessa che Israele usa per giustificare i blocchi e gli embarghi posti sul territorio della Striscia. E che la procura porta avanti con diversi riferimenti giuridici e documentali, ma che solleva interrogativi profondi sulla tenuta del diritto penale in contesti di conflitto armato e occupazione militare.
From a strictly legal standpoint, the Public Prosecutor's Office, after a lengthy historical introduction on Hamas, proceeds from the need to ascertain whether it can be classified under the provisions of Article 270 bis of the Criminal Code, which punishes association with the aim of international terrorism. On this point, the regulatory framework is clear: Hamas has been included in the European Union's lists of terrorist organisations since 2003, following the extension of the classification, initially limited to the al-Qassam Brigades, the military wing, to the entire organisation. Before then, only the military wing was included in that list, while the political aspect of the movement was recognised.
However, case law has repeatedly clarified that inclusion on so-called “black lists” is not in itself sufficient to classify an organisation as terrorist in criminal proceedings, but it constitutes an evidentiary element to be assessed together with the concrete findings of the investigation. This is what also reiterated by the recent Supreme Court (ruling no. 32712/2024), recalled in the inquiry documents.
La stessa giurisprudenza, peraltro, afferma che anche in un contesto di conflitto armato e di occupazione illegittima – quale quello dei Territori Palestinesi Occupati, come riconosciuto dal International law e dalla Corte Internazionale di Giustizia nel parere del luglio 2024 – le condotte violente dirette contro la popolazione civile integrano comunque atti di terrorismo. Hamas, sotto questo profilo, ha rivendicato decine di attentati suicidi che hanno colpito in larghissima parte civili israeliani, rafforzando la qualificazione terroristica dell’organizzazione (nelle carte si parla di 68 attentati, che hanno causato 484 morti e 3305 feriti).
The nature of Hamas
The heart of the accusatory stance, however, lies not so much in the terrorist nature of Hamas, recognised only by the “Western bloc” and not the UN, as in the interpretation of its internal structure. According to the Prosecution, there would be no clear separation between the military wing and the welfare (da‘wa) sector, as the latter would perform a function of proselytisation, social control, and indirect support for armed activities.
Indeed, the documents state: “Hamas is a unitary organisation, with no clear separation between its military and political wings, which is also reflected in the destination of funds coming from abroad, which cannot be clearly distinguished.” It would follow that any form of economic support directed to Gaza, even if to humanitarian associations, if channelled through structures attributable to the movement, would inevitably end up fuelling its terrorist activities as well. “The same da’wa sector does not carry out a function of exclusive social support for the civilian population (in the accusatory hypothesis, only for that part directly connected to the Movement), but some of the activities financed by associations operating in the educational and social sector are nevertheless connected, at least indirectly, to the movement's military aims as well.”.
This Genoese prosecutor demonstrates this connection through the Islamic-fundamentalist nature of the social activities, but also through the fact that some charitable works concern the wounded, prisoners, and so-called martyrs, thus the military wing of the movement. In fact, the documents do not show connections with attacks or defined terrorist activities, nor the purchase of war material intended for attacks on Gaza or Italian territory (the charge against the suspects is also that they are indeed an Italian terrorist cell of Hamas).
Furthermore, in the documents, a form of dawah activity outside the Strip's borders is identified in the collection of money and lobbying activities in countries of residence, which is precisely what the suspects are accused of.
Educational, health and charitable activities – it is stated in the documents – would not be neutral, but ideologically oriented and functional to the building of consensus, to the loyalty of the population and, in some cases, to the logistical and material support of militants and their families. From this perspective, Hamas-affiliated charitable associations, which the prosecution estimates to be half of those present in the Strip, would constitute an essential channel for the financing of the movement as a whole.
This reconstruction is based on documentation of Israeli origin, which describes a centralised network of control of charities through the so-called Department of Institutions, created after Hamas took power in 2007. According to these sources, systematically donating to certain associations would be equivalent to supporting Hamas, as there would be “independent” alternatives within the humanitarian sphere of the Strip.
È proprio qui che emergono le principali criticità. Hamas che come si ricordava sopra ha commesso diverse azioni terroristiche, ma è al tempo stesso un attore politico e amministrativo che governa Gaza da quasi vent’anni. Gestisce ospedali, schools, tribunali, servizi essenziali e impiega migliaia di dipendenti pubblici. Com’è stato osservato da diversi studiosi, Hamas è un movimento “ibrido”, complesso e stratificato, che intreccia dimensione militare, politica e sociale, nato ispirandosi al modello dei Fratelli Musulmani egiziano, e che ha una visione di Stato che non si distingue dal Corano e dalla sua manifestazione nella gestione della popolazione. Su questo la procura ricorda i due principali documenti che riguardano gli intenti di Hamas quello della sua fondazione (dove ci si riferisce allo Stato Islamico, alla Sharia e alla liberazione della Palestine contro il nemico ebreo, con intenti antisemiti) e quello aggiornato del 2017, e che la procura inserisce, per via dei suoi toni più risoluti, in una manovra del movimento per cercare consensi all’estero.
The fact that contact with Hamas is therefore automatically, according to the EU's recognition, contact with terrorism is what Israel has argued for decades, meaning there would be no possibility of humanitarian assistance without complicity with terrorism. A thesis which, if applied rigidly, leads to the generalised criminalisation of aid to Gaza and, in effect, the legitimisation of a form of collective punishment of the civilian population.
It is no coincidence that similar accusations have been levelled in recent years against dozens of international NGOs and even the’UNRWA, l’agenzia ONU per i rifugiati palestinesi, accusata di essere infiltrata da membri di Hamas, e che molti suoi dipendenti avessero partecipato al 7 ottobre, senza che siano mai state rese pubbliche prove giudiziarie solide. Le conseguenze sono state sospensioni di fondi, revoche di permessi e un ulteriore aggravamento della crisi umanitaria. Dall’inizio dell’offensiva che ha dato via al genocidio palestinese il governo israeliano ha revocato il permesso di operare nella Striscia a 37 organizzazioni umanitarie, tra cui Medici Senza Frontiere, ActionAid e Oxfam, perché non capaci di garantire standard di sicurezza sufficienti. Si intende, ovviamente, la sicurezza di Israele.
The Israeli dossiers
The second crucial node of the investigation concerns the origin and usability of the evidence. A very significant part of the prosecution's case, in fact the links between the Italian and Palestinian associations (and therefore, according to the prosecution, indirectly Hamas) is based on documents provided by Israel, “spontaneous information”, collected during military operations such as Defensive Shield, conducted in the West Bank about 20 years ago, and Swords of Iron, l’offensiva partita dopo il 7 ottobre 2023. Sono circa 120 documenti, distinguibili dalla sigla AVI, forniti da un agente israeliano la cui identità è nascosta anche agli stessi inquirenti italiani per motivi di sicurezza.
This is material delivered manually to the Italian authorities, produced by military and intelligence apparatuses, with parts redacted for reasons of Israeli national security. Documents that do not originate from judicial investigations or adversarial proceedings, but from the “battlefield”.
È da quei materiali, cioè da Israele, che si trae la conclusione che le associazioni umanitarie palestinesi siano tutte riconducibili ad Hamas. La stessa ABSPP (l’Associazione Benefica di Solidarietà con il Popolo Palestinese) l’associazione di Mohammad Hannoun, il principale indiziato, in carcere dal 27 dicembre, è classificata da Israele legata all’organizzazione islamica.
The lawyer and lecturer in criminal law Alessandro Diddi interviewed by Messaggero has noted how anomalous it is that the only element supporting any links between the recipients of cash transfers and Hamas derives exclusively from reports by the Israeli military or its intelligence agencies. On the same point Giandomenico Caiazza insists on TomorrowIt is necessary to ascertain how the Italian authorities acquired and used the information from Israel, and it would be extremely concerning if it had been an uncritical acceptance of intelligence material, devoid of any independent control and verification.
Anche per gli avvocati di Hannoun Fabio Sommovigo e Emanuele Tambuscio, in vista del Riesame, un nodo da sciogliere è la natura e l’utilizzabilità dei documenti forniti da Israele e utilizzati dai pm genovesi per dire che le associazioni destinatarie dei finanziamenti sono in realtà in mano ad Hamas. Si tratta di materiale sequestrato o formato “sul campo di battaglia – hanno spiegato i legali alle agenzie – e non sappiamo con quali modalità e quali garanzie procedurali o processuali da cui vengono ricavate una serie di informative che per noi sono atti di indagine da parte di una polizia estera e non di un’autorità giudiziaria, la cui natura sarà oggetto di studio nelle prossime settimane”. “C’è un uso copioso di documentazione fornita dal governo israeliano, non possiamo neanche dire dall’autorità giudiziaria israeliana, perché non si tratta di quella, ma di servizi alle dipendenze del ministero della Difesa. Quindi è una collaborazione inedita, con un’entità assolutamente sconosciuta”. Tambuscio aggiunge che, come sostenuto dai familiari di Hannoun, “la beneficenza è rivendicata e dichiarata da molti anni. In merito, c’è stata una precedente indagine con richiesta di archiviazione, e formalmente questa è la riapertura della vecchia indagine”.
In the early 2000s, ABSPP had already been involved in other legal proceedings, with the same accusations, but the Italian judiciary had already expressed strong reservations about the usability of this material. In 2010, the Public Prosecutor's Office in Genoa requested the case be dismissed, noting the difficulty, if not impossibility, of using documents acquired during military operations, in the absence of the guarantees provided by the Italian legal system. Public Prosecutor Francesca Nanni wrote as follows: «All of this, irrespective of the difficulty, and in some cases impossibility, of using the material transmitted by the State of Israel, often collected during actual military operations, and therefore without adherence to the fundamental principles governing the acquisition of evidence in our legal system.».
Today, the Public Prosecutor's Office maintains that Article 234 of the Code of Criminal Procedure allows the acquisition of documents created abroad, provided they were not obtained in violation of the law, also referencing recommendations from the Council of Europe on the use of information gathered in conflict zones. However, a fundamental question remains: can an Italian criminal proceeding be based on material produced by a state directly involved in the conflict, a state with an evident political and military interest? This is a decisive distinction. And the way Italian justice addresses it could set a precedent destined to go far beyond the Genoa case.
